1) The ones being used by players were very predominantly against the law, and those that weren't would quickly become against the law once the guvmint learned about them.
2) The vast majority of players who were busted/named were US citizens who bought them from dealers in the US and used them in the US. If there were tons of players who bought them legally in Mexico or the DR or wherever and used them only in Mexico or the DR or wherever one of them surely would have used this as a defense by now.

Basically what it boils down to is that the Tejada B-12 shot was brought up not as a "this caused the positive", but rather came up in response to a query of everything he had taken in that period (apparently SOP, and it makes sense in that context)
He wasn't blaming Tejada, he wasn't blaming the B-12 shot. He never raised the B-12 shot as an affirmative defense.
During the arbitration proceeding, Mr. Weiner stated, “The Players Association does not contend that the B-12 shot that Mr. Palmeiro took caused his positive test. We have no evidence to suggest that. As a matter of fact, all of the evidence that exists runs in the other direction.”183 In the Committee staff interview, Mr. Palmeiro was asked about Mr. Weiner’s statement:
Q: So do you disagree with that statement?
A: I disagree with what he is saying. He is speaking on the Players Association behalf; but I feel that the B-12 was probably the thing that might have done it. I could not prove it. I have no way of proving whether you know this was an unintentional thing that I did or something that somebody did to me. I couldn’t prove it.184
I realize it's not the way the world works, but I think the shortest route for Bonds, Clemens, maybe others would be to ask to be left off the 2015 ballot. No denial, no admission, just "We don't want this to continue to be a sideshow to the process."
But I'll still say that there's a difference between, " and "the only thing I can think of that could have caused the positive test was the B-12 shot" and "the B-12 shot caused the positive". YMMV.
