No, that's no longer part of the CBA.
The Marlins are committed to a long-term vision, just not one that includes Buehrle nor Reyes. Besides, it's a vision that is focused on maximizing Loria's accounts over other silly priorities that some players might hold.
Buehrle and Reyes are represented by Scott Boras and Peter Greenberg*, respectively. They've both been around the block a few times, they know what a back-loaded contract without a NTC means, and they know how the Marlins do business. I think it very unlikely that they did not explain these things to their clients.
*Greenberg recently sold his agency to Legacy Sports/Greg Genske. I don't know if this means that he works for Legacy, is retiring, or what.
If it's not in the contract it's worthless.
The only meaningful response here is "...but you will this time."
There's no way that a team can unilaterally enforce a policy that's not in the labor agreement. If they want to omit the no-trade clause, you either make them pay for it, or play somewhere else. It might be a tough negotiation, but that's what agents are for.
Keep in mind that Beeston's side deal with Clemens was not an oral agreement; it was actually written down. The problem for Beeston was that it was kept secret from the Commissioner's office and not submitted with the main contract.

Pierre has been worth an average of 1.5 WAR the last 4 seasons and was worth 1.7 last season, and has put up a respectable .344 OBP. He's definitely a guy who deserves a spot on a major league roster. Obviously, he has no power (.344 slugging over his last 4 seasons) but he does add value as a baserunner. He's not a starter for a championship ballclub but that's not going to be the 2013 Marlins anyway. For that money, he's more than a decent signing.
Buehrle is represented by Jeff Berry, not Boras. If he were with Boras, he wouldn't have signed two extensions with the White Sox before this contract.
