Angel Hernandez’s Lawsuit Against MLB Just Got Really Interesting | FanGraphs Baseball

But Hernandez missed something. Hernandez’s lawyers should have pointed out to the court that whether or not a labor relations privilege exists depends not on the forum state of the lawsuit, but instead based on the law of the state where the communications occurred. If Hernandez spoke with his union in St. Louis, for example, he would have done so in reliance on Missouri law, not New York procedural law. Without that, though, Hernandez was arguing only public policy – what the court should do, not what the court can do. As a matter of public policy, Hernandez had the better argument. As a matter of procedure, MLB had the far better argument. The court heard oral arguments on this issue, and on June 12 decided to side with MLB: the union was required to produce those documents. That’s a significant ruling, because there is now federal case law in MLB’s home federal forum that communications between an employee and their union is not confidential.

This holding is a game-changer for more than just the umpires. Should there be litigation between MLB and the MLBPA or a player, there will be no privilege protecting the player’s communications with the union from disclosure to MLB. For the MLBPA, that should be deeply troubling, especially given the fraught nature of its relationship with the league as we approach new CBA talks in 2021.

Report: Umpire Angel Hernandez Worries About Relation if He Speaks Out in Discrimination Case

Umpire Angel Hernandez plans to speak publicly on his allegations of racial discrimination in Major League Baseball nearly two years after filing a racial discrimination suit against the league, reports USA Today.

According to USA Today, Hernandez is seeking permission from the U.S. District Court for the Central District of New York to speak on a previously sealed list of 27 items. The list was submitted in March but unsealed this week. Hernandez’s allegations include that the “MLB has made professional life even harder for minorities in baseball” since Joe Torre was hired as an executive vice president in 2010.

Hernandez’s attorney Kevin Murphy alleges in the filing that: “MLB treats African Americans, Hispanics, Latinos and other people of color as competent to play the game based on their athletic ability, but MLB does not do nearly enough to promote African Americans, Hispanics, Latinos and other people of color to positions of leadership. MLB pays only lip service to preventing discrimination against African Americans, Hispanics, Latinos and other people of color.”

Angel Hernandez seriously ejected Astros manager A.J. Hinch in a spring training game

The baseball season hasn’t even started yet, and Angel Hernandez is already trending for the wrong reasons.

Hernandez, the home plate umpire during a spring training game on Friday between the Astros and Cardinals, tossed Astros manager A.J. Hinch one pitch into the bottom of the first inning.

Hinch grew irritated after a 1-2 pitch by Astros starter Forrest Whitley to the Cardinals’ Harrison Bader in the top of the first was called a ball. Bader later reached on an error.

So, how long before one or the other starts beating up marshmallow salesmen in their spare time?
