Judge sets new trial for Clemens in April

A U.S. district court judge granted federal prosecutors a new trial for former Major League pitcher Roger Clemens on Friday, setting a start date of April 17.

Clemens is accused of lying to Congress when lawmakers investigated the illicit use of steroids in professional baseball.

...U.S. District Court Judge Reggie Walton blasted prosecutors Friday, declaring, “I would hate to believe they just blatantly disregarded rulings that I made, but it’s hard for me to reach any other conclusion.”

Defense attorneys accused prosecutors of showing the clip deliberately, and asked Walton to dismiss the six-count indictment.

“No doubt this was a calculated effort to make an end run around this court’s ruling,” Clemens defense attorney Michael Attanasio said.

Yeah. IANAL, but I thought that mistrials due to prosecution misconduct weren't normally granted new trials.

So Prosecution perjures itself by claiming it was all an accident and still gets excused by the judge to pursue the perjury and spend millions more that must be borrowed from China. Prosecution wins all the way since they got more time to prepare and everyone now knows what Pettites wife said, even the new jury.

Had more justice when King George III was in charge, lower taxes too.

I don't think this will be reversed on appeal (should Clemens appeal). Walton could have gone the other way, but his decision here is in bounds as well.

#6 -- two questions: first, is this even subject to interlocutory appeal without the court certifying it and, second, isn't the standard for reversal abuse of discretion?
