1. Avoid running at all times.-S. Paige Posted: August 12, 2011 at 03:04 AM (#3898478)OK, so only the first four tweets related to the fight. I got carried away.
Yeah, that'll happen. Amazing he had so much patience at the plate.
It's nice to see Jose Canseco supporting gay couples when it comes to adopting children, but I question his rigidity when it comes to family planning.
Unrelated: Eri Yoshida got her first US pro win yesterday (with Maui) ... whose next opponent (the much discussed Lake County club) failed to show up in Maui for their series that began tonight. Presumably, that club is now dead.
Ha! Yeah I guess that might also explain the incessant spitting and weird nervous tics as well.
Dunno about first, but I would pay good money to see Busey coach third.
Aren't we all just looking for a nice holesome girl?
It warms my heart that some dude has probably walked, fresh off of smoking a bowl, into a wendy's next to a strip mall in some out-of-the-way western town and been greeted by the twitching visage of Jose Canseco.
As an aside.
Phillips, the Canseco twins, Willy Aybar...not to mention David Cross!
There's an interesting book just begging to be written about that team.
Yuma used a DH (Joey Gathright) in Canseco's CG.
shush!! you're getting tony larussa all hot and bothered.
I wondered the same thing (and I don't love TP, FWIW). While Phillips was obviously jawing and moving closer, it's pretty clear that Marshall was the one who made the rush. I'm not a lawyer, but I have to wonder if "I got my ass kicked in a fight I started" is a terribly effective argument for assault.
When I saw that headline at hbt I thought it was a celebrity boxing match.
Wow. How are the ... well, not mighty, but still ... fallen. Gathright was the first player from the local AA franchise to be called up to the bigs; it wasn't that long ago.
Was it?
(Checking: 2004.)
Me neither. I'm guessing Marshall's recollection of the incident is a tad biased and doesn't really agree with the tape.
IANACL, but I think Phillips would have a reasonable claim to self defense. The basic question is whether Phillips used a level of force that was reasonably necessary to protect himself from bodily harm that might have resulted from Marshall's onslaught. Given that Marshall made a mad rush for Phillips, I'd think such a defense would fly -- even if Phillips is the one who started the jawing. (In that case Phillips can argue that even though he is the one who started yapping, Marshall responded with a greater and unforeseeable level of force.)
The basic test is whether a reasonable person in a similar circumstance as Phillips would respond with a level of force similar to the level Phillips used to respond -- taking into account things like the size, strength, and age of the parties.
The lesson is don't threaten someone who can probably kick your ass (and who is willing to) with physical violence.
For real. It's hard to tell, but my guess is Marshall meant to get up in Phillip's face and maybe chest bump him, not expecting that Phillips would take that as an invitation to fight. If you angrily rush up to someone like that though, you better be prepared.
