Marty Appel loses 22 items of his memorabilia collection as Mantle’s restaurant closes its doors

As Marty just FB’d…“No good deed goes unpunished…...”

The sudden shutdown of Mickey Mantle’s restaurant cost Yankees historian Marty Appel a huge piece of his pinstriped past — 22 framed items from his memorabilia collection.

“Where’s the justice? Nobody denies that these are my things,” said Appel, author of the best-selling book “Pinstripe Empire.”

“The bankruptcy court seems to be taking the position, ‘We don’t care. If it was in there, it’s ours.’ They just say tough luck.”

...Appel said his items, while not worth a fortune, carry an inestimable personal value.

They include lithographs of some seminal moments in Yankee history, including Reggie Jackson’s third homer in Game 6 of the 1977 World Series and Chris Chambliss’ 1976 blast against the Royals to propel the Bronx Bombers into the Series.

“It’s very disappointing,” Appel said. “I was just trying to do a good deed, and now I’m losing my personal possessions.”

If he donated the stuff to the restaurant, it wasn't his property anymore.

When the struggling restaurant fell $400,000 behind on its back rent, a company that provided Mantle’s with memorabilia came in and stripped the walls clean, Appel said.
He then volunteered the pieces from his collection with the understanding that everything would be returned if the restaurant closed — and it did, on June 5.

Sounds like he lent, and not gave, them to the owner, and not in return for money, with the expectation that they would be returned.
If I lend you my lawnmower for a few hours and you go bankrupt, then I don't get it back?

As a frequent watcher of Judge Judy I would say "Did you get it in writing? Did you get it in writing, sir? Do you have a document? Bill of sale? No? Oral contract? Is there any recording of this phone call in which you established the oral contract? No? Then as far as anyone can tell, it was a gift. Next case."

According to the NY Times, Judge Judy makes $45 million per year, and only works 5 days per month.

Actually, it is legally binding on the parties themselves.

From wikipedia:
Judge Judy is a daytime reality show featuring former family court judge Judith Sheindlin arbitrating over small claims cases in a small claims "court." While the claims are real, the "court" is not a public court of law but a private arbitration court, and all parties must sign contracts agreeing to arbitration under Sheindlin. ...

The court show acquires cases by people submitting claims into them via their website or phone number. The producers' employees call both parties in advance and ask them questions about their case to make sure it is suitable for Judge Judy. If the parties agree to be on the show and sign a waiver, agreeing that arbitration in Sheindlin's court is final and cannot be pursued elsewhere (unless she dismisses the lawsuit without prejudice), their case will air on Judge Judy. The award limit on Judge Judy, as on most "syndi-court" shows (and most small claims courts in the U.S.), is $5,000. The award for each judgment is paid by the producers of the show, from a fund reserved for the purpose.

EDITed: to add this clarification:
Even this status has been disputed: in Doo Wop Shoppe Ltd. v. Ralph Edwards, syndi-court justice was determined not to be an actual form of arbitration because a third party pays part of the cost of the judgment. This decision was subsequently overturned.

The American Bar Association notes that:

"B.M. v. D.L.", the Family Court of Kings County, New York, overturned part of a Judge Judy decision. The parties had appeared in front of Judge Judy over a dispute involving personal property. However, Judge Judy made a decision involving child custody and visitation. The court overturned the custody and visitation part of her decision on two grounds. First, it was a matter that was not covered by the agreement to arbitrate. Second, as a matter of public policy, an arbitrator could not decide child custody and visitation rights. Considering that Judy had been a judge in New York's family court, it is particularly ironic that she decided to overstep her arbitral authority on this particular issue.

And actually, while she obviously is not acting in her capacity as such on the show, judge Judy was a real judge I new York family court for years.

I have a record of the purchase and repair of my beloved lawnmower. When I am mowing my lawn, no one can touch me.

I am trying to go all suburbia and grow a lawn this summer - even had a sprinkler system installed. My bermudagrass front yard is, at the moment, patchy but surviving.
