The whole thing is a mess. There is something both unseemly and unsurprising about a modern politician using legislation as a tool to punish the political behavior of a corporate entity. Nevertheless, the generally more serious Sen. Mike Lee (R–Utah), another co-sponsor of the bill, was on firmer footing when he asserted at the same press conference that MLB “has used its judicially fabricated antitrust immunity to suppress wages and divide up markets for decades—conduct that is plainly illegal, and sometimes criminal, in any other industry.”

1. Hombre BrotaniEr, the first modern indy leagues were the Frontier League (still extant) and the Northern League, which both started play in 1993.
Also, this article is from last October.
Personally, I don't care who in congress decides to repeal the anti-trust exemption from MLB or why they choose to do it. If they do it, I will applaud. I don't care what letter is after their name on the ballot.
