Mike Bolsinger’s Lawsuit Against Astros over Sign-Stealing Scandal Dismissed

A judge in California dismissed a lawsuit against the Houston Astros filed by former MLB reliever Mike Bolsinger, according to The Athletic’s Daniel Kaplan.

Bolsinger filed suit in February 2020, alleging the Astros’ sign-stealing scandal irreparably damaged his career. In what remains his last MLB appearance, he allowed four earned runs over a third of an inning while with the Toronto Blue Jays in an August 2017 game in Houston.

Judge David Cowan of the Los Angeles Superior Court didn’t find Bolsinger’s suit had merit.

“If that’s sufficient to sustain jurisdiction in California, it would be sufficient to sustain jurisdiction in any state of the United States that has an American League team,” Cowan said, per Kaplan.

The judge went on to say Bolsinger purposefully chose to pursue the case in California to potentially capitalize on any lingering resentment toward the Astros after they defeated the Los Angeles Dodgers in the 2017 World Series:

“I don’t think that’s what we’re talking about. In this case, what we’re talking about is the fact that every single person that would be a witness in this case, lives in Texas. There is no single contact between California and this case … I don’t think you took a state out of the blue, you took the Los Angeles Dodgers out of the blue and perhaps thought it was, that perhaps the jury or even the judge could feel badly about the fact that the Houston Astros won the World Series.”

The complaint makes it sound like he had to turn in his uniform right on the mound.

Plaintiff Bolsinger was a professional relief pitcher with the Toronto Blue
Jays who was called into the game by his team on August 4, 2017 after the prior
pitchers on his team gave up several runs. In .1 innings pitched, Plaintiff Bolsinger
gave up 4 runs to the Defendant Astros and was immediately terminated and cut from
the team never to return to Major League Baseball again

So is he allowed to refile in Texas or somewhere else he thinks he would have standing? Personally I think this is a nonsense suit but I'm just curious about the legal angle.

I haven't read the pleadings, but based on what's here, arguing that jurisdiction was proper in California seems absurd, and his counsel was testing the limits of Rule 11 (which basically says that you have to have a good faith basis for all representations to the court).

LA County is the proper venue because that's where the World Series ended or something.

Venue is proper in this county because a significant portion of the
activities giving rise to the claims in this action occurred in the County of Los
Angeles. Specifically, (a) Los Angeles is the situs where the Defendant Astros
fraudulently won the 2017 World Series; (b) upon information and belief, Defendant
has member-investors involved in the fraudulent scheme who reside in Los Angeles,
California; and (c) the impact and damages caused within the County of Los Angeles
exceeds all other jurisdictions and substantial tortious conduct was directed at Los
Angeles.

LA County is the proper venue because that's where the World Series ended or something.
If I were the judge, I would not hesitate to slap sanctions on counsel for that BS.
