Phillies Phile Lawsuit To Prevent Phanatic Phrom Becoming Phree Agent

Biggest mascot case since the Mr. Met - Mrs. Met divorce?

In a federal lawsuit filed Friday in U.S. District Court in New York, the Phillies accused Harrison/Erickson Inc., the creators and designers of the Phanatic, of threatening to withdraw from their 1984 agreement to let the Phillies use the mascot “forever.” According to the suit, the designers have “threatened to obtain an injunction against the Phillies’ use of the Phanatic” and “make the Phanatic a free agent,” selling the rights to the furry, green-beaked creature to another sports team if the Phillies do not renegotiate with the mascot’s creators and pay them “millions of dollars.”

clearly, this is a marketing campaign for the new season of it's always sunny in philadelphia, which premieres at 10PM on september 25, on FXX.

Clicked on the "mascot law" tag to see if anything else came up. I was disappointed and not surprised that this was the first time that it was used.

also, i just want to point out that the reason why the phillies have had a very bad bullpen this season is because their possibly very good one is rotting away on the injured list:
Seranthony Dominguez         Elbow            There is no timetable for recovery.
David Robertson              Elbow             season-ending surgery
Adam Morgan             Hip Flexor                                           A timetable 
for return has yet to be established.
Pat Neshek               Hamstring      not expected to return until sometime in September.
Tommy Hunter               Forearm                                                season-ending surgery
Edubray Ramos             Shoulder                                            will miss an extended length of time
Victor Arano                 Elbow                            The team has yet to provide a return date

the phillies are paying:
robertson 10MM for 6 IP
hunter 9MM for 5 IP
neshek 8MM for 18 IP with a 5.0 ERA

they're also paying juan nicasio 9MM for a 5+ ERA.

other things have gone various levels of sideways for the phillies this season, but this concentration of injuries to their relievers is what has blown the season up.

Mascot law: I'm pretty sure there was a similar lawsuit over the SD Chicken although I suspect the contract details were different. The Chicken eventually won the creative rights but could not be the SD Chicken and became the World Famous Chicken (if memory serves).

Questions for our local legal beagles:

Is "forever" a word with legal standing meaning what we think it means?

Surely "forever" doesn't mean the price can't go up, right? And what happens if the "forever" party doesn't want to pay?

Unless there was language that these "forever" rights were exclusive, that still wouldn't prevent them from pimping out the Phanatic to other users would it?

Like the Chicken, would the Phanatic lose not only the "Philly" connection but even the use of the "Ph"?

3, the good thing is that Nishek, Hunter and Nicasio are gone after this season.

And Robertson's contract was almost certainly insured, so while the Phillies will have the liability on the books, they'll be getting most of his 2019 & 2020 money back.
