Pro-business group files lawsuit against MLB for pulling All-Star Game from Atlanta

A pro-business group filed a federal lawsuit on Monday against Major League Baseball, claiming it had no right to move the All-Star Game from Atlanta in protest of Georgia’s restrictive voting law.

An Addison, Texas-based organization called Job Creators Network said “thousands of hard-working ordinary men and women in the Atlanta area” had been banking on proceeds from this year’s All-Star Game before: “Defendants took this all away in the blink of an eye.”...

The lawsuit even went as far as to invoke the Ku Klux Klan.

By moving the All-Star Game, defendants are violating the Ku Klux Klan Act of 1871 by hindering “Georgia’s duly elected government from ensuring equal protection of the laws,” according to the lawsuit.

The plaintiffs also claimed MLB and the union are running afoul of the 14th Amendment’s equal protection clause. The 14th Amendment was adopted in 1868 and guarantees the rights of all Americans following the end of slavery.

“This is the dumbest complaint I have ever read,” Jarvis told NBC News. “If this was turned in as a law school exam, you would have given it an F and counseled the student to find a different line of work.”

Of course you might be correct. And the lawsuit seems without merit. And Georgia's laws are problematic. But it's still a cheap shot.

As I saw someone note elsewhere, I would love to have MLB end up on record about how the All-Star game really doesn't bring in that much money. I know it will never get that far, but I can dream.

this one won't get that far, but that's indeed what happens in cases I have seen.

if you have to give a deposition, your attorney will tell you to be truthful about everything - especially if the truth is not a crime. lying under oath would be the real jeopardy.

there was a good one where a company won a lawsuit based on the testimony of numerous executives that the whole public pitch was a hoax to trick naive lawmakers into passing their proposal - therefore there was no way that the plaintiff was told, as he claimed, that he would get his project completed as part of a fake plan.

I suspect it will make it a bit more difficult for awhile to get municipal and state funding for these types of things.

I know this one when get anywhere. I doubt the merits. But as I said, I would love to see it.

How do they even have standing?

The job creators netword -- "the voice of real job creators" -- "believe that many government policies are getting in the way of the economic freedom that helped make this country prosperous." Like how they are ludicrously trying to use government regulation to limit the "economic freedom" of MLB to play the AS game wherever the F they want to.

"Job Creators Network is a nonpartisan organization whose mission is to educate employees of Main Street America, so we can protect the 85 million people who depend on the success of small businesses." Small businesses like Home Depot whose co-founder began the JCN.

Based on their website, they appear to be a for-profit corporation -- I can find no claim to be non-profit much less a 501c3 or similar claim. And their donate button wasn't working for me. Their main activity seems to be taking out full-page ads and billboards decrying "government overreach" (you know, healthcare, minimum wage, that sort of stuff) and attacking Amazon whose economic freedom they claim is driving small businesses under. (Is that last bit true? Amazon Australia is pretty much nothing but small Aussie businesses selling stuff.)

Yeah, Amazon is pretty much a monster in the USA - not only can they undercut just about any local retailer and in many cases deliver within a couple of days, they've also got a nasty habit of seeing what the people who use them as a fulfillment service are selling, manufacturing their own branded version, and driving the original company out of business. Then their delivery drivers are classified as contractors on the Uber model, working on a commission model that can dip below minimum wage. I try to mostly use them just for movies these days, since there's not exactly local places selling physical media.

Not that JCN is necessarily less evil, just less effectively so.

You learn that most detrimental reliance does not give rise to promissory estoppel the first month of law school in Contracts.

Standing is covered in either first or second semester in Con Law I.

We have what sounds like a promissory estoppel claim filed on behalf of businesses in Atlanta and/or the State of Georgia who detrimentally relied on MLB's initial decision to site the ASG in Atlanta. Except it's some association with at best a limited relationship with said businesses and none with the State of Georgia. (And that's before we get to the part where non-parties to agreements assert promissory estoppel, which, no, that is really not how it works.)

And then there's something in here about a claim that MLB is somehow illegally hindering Georgia's voter suppression law, which is stranger than everything else in here. I have no idea what their claim to standing for such claims would even be.
