Report: MLBPA Files Grievance Against Yankees over Jacoby Ellsbury’s Contract

The Major League Baseball Players Association has reportedly filed a grievance on behalf of former New York Yankees outfielder Jacoby Ellsbury.

According to Ronald Blum of the Associated Press, the MLBPA filed the grievance in an effort to regain $26 million it believes is still due to Ellsbury. In November, the Yankees converted his seven-year, $153 million contract to a non-guaranteed one and then released him because they said he received unauthorized medical treatment from Dr. Viktor Bouquette of Progressive Medical Center in Atlanta, per Blum.

Ellsbury believes he didn’t need permission from the team to receive treatment for a non-baseball-related injury or condition.

Blum noted arbitrator Mark Irvings is expected to hear the grievance unless there is a settlement. He is the same arbitrator who will decide on the service time grievance filed on behalf of Chicago Cubs third baseman Kris Bryant.

So Mark Irvings is expected to still be the arbitrator in 4 years or do some grievances get addressed in a timely manner?

IANAL but did Bryant’s grievance get pushed until he reaches free agency when there can be meaningfully damages assessed? Meanwhile Ellsbury has some urgency on his because if/how/when he signs elsewhere is going to be impacted by what happens with his Yankee deal.

Yeah, nobody was pushing for a resolution of Bryant's greivance (though I'm still surprised it was pushed off this long) while Ellsbury's is a rather immediate concern to Mr. Ellsbury and the Yankees.

IANAL but I don't see how the Yanks have a leg to stand on. Yes, the CBA gives teams the right to approve medical care (for baseball injuries, etc) but the only stated punishments are fines or possibly a suspension. There's no mention of being allowed to convert a guaranteed contract to a non-guaranteed contract. It's further hard to see how they could possibly justify a $26 M fine or a year's suspension -- but they didn't do either of those anyway. And of course it's very easy for Ellsbury to claim this was treatment unrelated to baseball.

If Ellsbury refused to follow the medical/rehab advice of their staff while they were paying him $26M p.a., I think they have a case. Whether they can prove it is another matter.
